Use of Artificial Intelligence
1. Scope of Application
1.1
This Policy on the Responsible Use of Artificial Intelligence (“AI Policy”) sets out the principles for the provision, integration and use of AI-supported services, applications and functions within the digital ecosystem of Drion AI AG, Kantonsstrasse 32, 6207 Nottwil, Switzerland (hereinafter “Drion AI” or the “Provider”).
1.2
This AI Policy applies to all AI-supported services, applications and functions that are provided or integrated by Drion AI AG or made accessible within the scope of its platforms and digital services. These may include in particular:
- AI assistants,
- integrated AI services,
- language models,
- image and media generators,
- automation and analysis functions,
- intelligent search and recommendation systems,
- as well as other AI-supported applications.
This list is not exhaustive.
1.3
This AI Policy supplements the General Terms and Conditions of Drion AI AG (DLA- AGB-001) as well as other supplementary policies and terms of participation. Unless this AI Policy contains provisions to the contrary, the provisions of the General Terms and Conditions shall apply accordingly.
1.4
The AI services provided by Drion AI AG may be based on proprietary developments, licensed technologies or integrated third-party services. Unless expressly stated otherwise, the provision or integration of an AI service does not constitute any statement regarding ownership of the underlying technologies, models or intellectual property rights.
1.5
This AI Policy applies to all users, organisations and other authorised persons who use AI-supported services or functions within the digital ecosystem of Drion AI AG. Supplementary terms of use may apply to individual AI services or applications. Where such terms exist, they will be made available to users prior to the respective use.
1.6
Drion AI AG continuously develops its digital ecosystem as well as the AI- supported services used therein. This AI Policy therefore also applies to AI services, functions and applications introduced in the future, unless specific rules are published in respect thereof.
1.7
This AI Policy does not confer any entitlement to the provision of specific AI services, functions or technologies. Drion AI AG is entitled to further develop, replace, integrate or discontinue AI services, taking into account the legitimate interests of users as well as for technical, economic, legal or regulatory reasons.
2. Principles of AI Use
2.1 Responsible Use
Drion AI AG uses artificial intelligence responsibly and in compliance with applicable statutory provisions as well as recognised ethical principles. The use of AI-supported services is intended to support users in the provision of digital services, to optimise workflows and to continuously further develop the added value of the digital ecosystem.
2.2 Human Responsibility
AI-supported services serve to support human decisions and processes. Unless expressly provided otherwise, AI-generated content or recommendations do not replace an independent review or decision by the user.
2.3 Transparency
Drion AI AG strives to make the use of AI-supported services within its digital ecosystem transparent. Where technically and organisationally feasible, users will be informed when content or functions are wholly or partly supported or generated by AI.
2.4 Fairness and Non-Discrimination
Drion AI AG aims to deploy AI-supported services in a non-discriminatory, fair and responsible manner. Where influence can be exercised over the design or configuration of the AI services used, appropriate measures will be taken to avoid systematic disadvantages or undue bias as far as possible.
2.5 Data Protection and Confidentiality
In the use of AI-supported services, Drion AI AG observes the applicable data protection provisions as well as the requirements of confidentiality and information security. The processing of personal data is governed by the Privacy Policy of Drion AI AG DLA-DP-001.
2.6 Security
Drion AI AG takes appropriate technical and organisational measures to ensure the security and integrity of the AI-supported services provided as well as of the digital ecosystem.
2.7 Continuous Further Development
Drion AI AG continuously reviews and further develops its principles for the use of artificial intelligence in order to take due account of technical developments as well as statutory and regulatory requirements.
3. AI Services within the Digital
Ecosystem
3.1 Provision of AI Services
Within its digital ecosystem, Drion AI AG provides or integrates AI-supported services, applications and functions in order to offer users digital services with an extended range of functions. The AI services provided may be based on proprietary developments, licensed technologies or integrated third-party services.
3.2 Areas of Use
AI-supported services may be used in particular in the following areas:
- support in the creation, editing or analysis of content,
- automation of workflows,
- intelligent search, assistance and recommendation systems,
- analysis and evaluation of information,
- support in communication and collaboration,
- provision of personalised functions,
- as well as other AI-supported applications within the digital ecosystem.
This list is not exhaustive.
3.3 Further Development of AI Services
Drion AI AG continuously further develops the AI services used within its digital ecosystem. This may include in particular the introduction of new functions, integrations, models or technologies, the expansion or replacement of existing services, and the provision of new AI-supported applications.
3.4 Integration of Third-Party Services
To provide individual AI functions, Drion AI AG may integrate third-party services or technologies. The selection of such services is made taking into account technical, economic, security-related and legal requirements.
3.5 Availability
The nature, scope and availability of individual AI services may differ depending on the respective digital service, the selected service package, technical prerequisites or statutory and regulatory requirements. There is no entitlement to the provision of specific AI services or functions.
3.6 Changes and Discontinuation
Drion AI AG is entitled to further develop, restrict, replace or discontinue AI services or individual functions for technical, economic, legal, regulatory or security-related reasons. The legitimate interests of users will be duly taken into account in this regard.
3.7 Supplementary Terms of Use
Supplementary terms of use, technical specifications or specific service descriptions may apply to individual AI services or applications. Where such provisions exist, they will be made available to users in an appropriate manner prior to the respective use.
3.8 Responsibility in the Selection of AI Services
Drion AI AG selects AI services and integrated technologies with due care. In particular, aspects of functionality, security, data protection, reliability and – where relevant to the respective application – transparency and legal requirements are taken into account. However, the selection or integration of an AI service does not constitute any warranty of error-free operation or unrestricted availability at all times.
4. Responsible Use
4.1 Principle
Users undertake to use AI-supported services within the digital ecosystem of Drion AI AG responsibly, with due care and in accordance with applicable statutory provisions, the General Terms and Conditions DLA-AGB-001, this AI Policy and other applicable policies.
4.2 Personal Responsibility
The use of AI-supported services is at the user’s own responsibility. Users are obliged to review AI-generated content appropriately for plausibility, completeness, accuracy and suitability for the intended purpose prior to its use or onward transmission.
4.3 No Exclusive Basis for Decisions
AI-generated content, recommendations or analyses serve solely as support. They do not replace professional, legal, medical, tax, financial or other professional advice, nor any independent decision by the user.
4.4 Permissible Use
AI-supported services may be used exclusively for lawful purposes and within the scope of the intended use. Users undertake in particular not to create, disseminate or use any content that violates applicable law, third-party rights or this AI Policy.
4.5 Protection of Personal and Confidential Data
When using AI-supported services, users should carefully review which information is entered or processed. Unless expressly provided for or legally permitted, no personal data, trade secrets or other confidential information should be entered whose processing is not necessary for the respective purpose.
4.6 Misuse
Any misuse of AI-supported services is prohibited. This includes in particular:
- circumvention of technical or organisational protective measures,
- use for the commission of unlawful acts,
- creation or dissemination of unlawful content,
- manipulation or impairment of the AI services provided,
- automated abusive use contrary to the specifications of Drion AI AG.
This list is not exhaustive.
4.7 Consequences of Breaches
In the event of breaches of this AI Policy or of applicable law, Drion AI AG is entitled to take appropriate measures. These may include in particular the restriction or blocking of individual AI services, the suspension of the user account, or further measures pursuant to the General Terms and Conditions DLA-AGB-001.
5. Transparency and User Responsibility
5.1 Labelling of AI Use
Where technically and organisationally feasible, Drion AI AG informs users when content, functions or results have been wholly or partly created or supported by AI-supported services.
5.2
AI-Generated Content AI-supported services may automatically generate content, analyses, recommendations or other results. Such content serves solely to support users and does not constitute binding statements or warranties by Drion AI AG.
5.3 Independent Review
Users are obliged to independently review AI-generated content for plausibility, completeness, accuracy and suitability for the intended purpose prior to its use or onward transmission. Responsibility for the use and further processing of the results lies with the respective user. Users remain solely responsible for all decisions and actions taken on the basis of AI-generated content.
5.4 No Warranty for Results
Drion AI AG does not warrant that AI-generated content is at all times complete, accurate, up to date, error-free or suitable for a particular purpose. AI-supported services may produce inaccurate, incomplete or misleading results.
5.5 Professional Decisions
AI-generated content does not replace professional, legal, medical, tax, financial or other professional advice. Decisions with legal, economic or other material implications must be taken by the user independently or reviewed with the involvement of appropriate professional advice.
5.6 User Feedback
Drion AI AG welcomes user feedback regarding erroneous, inaccurate or misleading AI-generated content in order to continuously improve the quality and further development of the AI services provided. The submission of feedback does not give rise to any entitlement to a particular response, correction or further development.
5.7 Continuous Further Development
Drion AI AG continuously reviews and further develops the AI services used within its digital ecosystem. Technical developments, user feedback as well as statutory and regulatory requirements are duly taken into account in this regard.
6. Data Protection and Confidentiality
6.1
Processing of Personal Data The processing of personal data in connection with AI-supported services is carried out exclusively in accordance with the applicable data protection provisions as well as the Privacy Policy of Drion AI AG DLA-DP-001. The nature, scope, purposes and legal bases of processing are set out in the Privacy Policy as amended from time to time.
6.2 Responsible Handling of Data
Drion AI AG strives to provide and integrate AI-supported services in such a way that the principles of data protection, data security and confidentiality are duly taken into account. Appropriate technical and organisational measures are taken for this purpose, insofar as they fall within the area of responsibility of Drion AI AG.
6.3 Responsibility of Users
Users are responsible for carefully reviewing which information is entered or processed when using AI-supported services. Unless expressly provided for or legally permitted, no personal data, trade secrets or other confidential information should be entered whose processing is not necessary for the respective purpose.
6.4 Integrated AI Services and External Technologies
Where AI-supported services are based on integrated third-party technologies or services, their integration is carried out taking into account the applicable data protection requirements. Further information on the processing of personal data is set out in the Privacy Policy of Drion AI AG DLA-DP-001 and, where applicable, in the supplementary information relating to the respective services.
6.5 Confidentiality
Drion AI AG undertakes to protect confidential information processed in the course of providing its digital services in accordance with statutory provisions as well as the contractual agreements in place. Where users process confidential information via AI-supported services, they bear responsibility for ensuring that such processing is legally permissible and does not infringe third-party rights.
6.6 Changes to Data Protection Requirements
Drion AI AG regularly reviews its processes relating to data protection and information security and adapts them as necessary to technical, statutory or regulatory developments. The Privacy Policy of Drion AI AG DLA-DP-001 as amended from time to time shall be decisive.
7. Intellectual Property and AI-Generated
Content
7.1 Rights of Drion AI AG
All rights in the platforms, applications, software, trademarks, logos, designs, databases, documentation and other content provided by Drion AI AG remain, unless expressly provided otherwise, with Drion AI AG or the respective rights holders. The use of such content is governed by the General Terms and Conditions (DLA-AGB-001) as well as the applicable terms of use.
7.2 Third-Party Rights
Where third-party AI-supported services, technologies or content are integrated within the digital ecosystem, the rights therein remain with the respective rights holders. The provision or integration of such services does not confer any transfer of intellectual property rights to users.
7.3 User Inputs
Rights in the content, data or other information entered by the user remain in principle with the respective user or the respective rights holder. The user warrants that they are entitled to use the entered content in the course of using the AI services and that no third-party rights are thereby infringed.
7.4
AI-Generated Content AI-supported services may automatically generate content on the basis of user inputs. Drion AI AG does not warrant that proprietary rights arise in AI-generated content or that such content is free from third-party rights. The use of AI-generated content is at the user’s responsibility and subject to the applicable statutory provisions.
7.5 Responsibility for Use
Users themselves are responsible for reviewing, prior to the publication, onward transmission or commercial use of AI-generated content, whether third-party rights, statutory provisions or contractual obligations preclude such use.
7.6 Rights under the Terms of Integrated AI Services
Where supplementary licence, usage or business terms of the respective providers apply to individual integrated AI services, such terms remain unaffected. Users are obliged to observe these supplementary terms insofar as they are made available to them prior to use or must be incorporated by law.
7.7 No Transfer of Proprietary Rights
The use of AI-supported services does not grant either the user or Drion AI AG any further rights in the underlying AI models, technologies or other proprietary rights, unless this has been expressly agreed.
8. Prohibited Use
8.1 Principle
AI-supported services within the digital ecosystem of Drion AI AG may be used exclusively in accordance with applicable statutory provisions, the General Terms and Conditions DLA-AGB-001, this AI Policy and the respective terms of use.
8.2 Impermissible Use
The use of AI-supported services is in particular impermissible where it serves to
- violate applicable law,
- impair or infringe third-party rights,
- prepare, promote or
carry out criminal or administrative offences,
- create or disseminate harmful, misleading or fraudulent content,
- circumvent technical protective measures or security mechanisms,
- malware, phishing, social engineering or other cyberattacks to
support,
- generate or disseminate discriminatory, insulting, defamatory, hateful or
violence-glorifying content,
- unlawfully process personal data or confidential information
or disclose such data,
- impair the functionality, security or integrity of the AI services or of the digital
ecosystem. This list is not exhaustive.
8.3 Abusive Automation
The use of automated systems, scripts, bots or comparable technologies for the abusive use, manipulation or circumvention of technical restrictions of the AI services is prohibited, unless Drion AI AG has expressly authorised such use.
8.4 Compliance with Statutory and Regulatory
Requirements Users undertake to comply with all statutory and regulatory requirements applicable to the use of AI-supported services. Where required by law or by public authorities, Drion AI AG may restrict or prohibit the use of individual AI services or functions.
8.5 Measures in the Event of Breaches
In the event of breaches of this AI Policy or of a justified suspicion of impermissible use, Drion AI AG is entitled to take appropriate measures, taking into account the legitimate interests of the user. These may include in particular:
- the restriction or blocking of individual AI services or functions,
- the temporary suspension of the user account pursuant to the General
Terms and Conditions DLA-AGB-001,
- the refusal or interruption of individual processing operations,
- the assertion of statutory or contractual claims.
8.6 Investigations
Drion AI AG is entitled to follow up on justified indications of breaches of this AI Policy and to evaluate the information required for this purpose, insofar as this is carried out in accordance with applicable data protection provisions. During an ongoing review, individual AI services or functions may be temporarily restricted insofar as this is necessary and proportionate.
8.7 No Entitlement to Continued Use
Where statutory, regulatory, technical or security-related reasons necessitate a restriction or termination of the use of individual AI services, there is no entitlement to their continued provision. Mandatory statutory rights of users remain unaffected.
9. Changes to AI Services
9.1 Further Development of AI Services
Drion AI AG continuously further develops the AI services provided or integrated within its digital ecosystem in order to take due account of technical innovations, statutory and regulatory requirements and the needs of users. This may include in particular the introduction of new functions, applications, models, integrations or technologies as well as the expansion, replacement or further development of existing AI services.
9.2 Changes to the Scope of Services
Drion AI AG is entitled to expand, adapt or restrict AI-supported services, applications or individual functions with effect for the future, provided there is an objective reason for doing so. An objective reason exists in particular in the case of:
- technical further developments,
- changes to integrated AI services or technologies,
- statutory or regulatory requirements,
- security measures or prevention of misuse,
- further development of the digital ecosystem of Drion AI AG,
- economic or organisational reasons,
- other comparable objective reasons.
9.3 Changes to Integrated AI Services
Where third-party AI services or technologies are integrated within the digital ecosystem, changes, adaptations or the discontinuation of such services may affect their availability or range of functions. Drion AI AG will endeavour to keep any resulting effects on users as limited as technically, economically and legally possible. There is no entitlement to the provision of a particular AI service or a particular technology.
9.4 Information of Users
Users will be informed of material changes to the AI services provided or to this AI Policy in good time and in an appropriate manner. Where required by law or provided for contractually, the consent of users will be obtained.
9.5 Discontinuation of Individual AI Services
Drion AI AG is entitled to discontinue individual AI services or functions for technical, economic, legal, regulatory or security-related reasons or to replace them with equivalent or further developed solutions. The legitimate interests of users will be duly taken into account in this regard.
9.6 Changes due to Statutory Requirements
Where statutory or official requirements necessitate adaptations to the provision or use of AI services, Drion AI AG is entitled to make corresponding changes. These may include in particular additional security measures, usage restrictions or organisational adaptations.
9.7 Continued Validity of Other Agreements
Changes to or the discontinuation of individual AI services do not affect the validity of the General Terms and Conditions DLA-AGB-001, the Privacy Policy (DLA-DP-001) or other supplementary policies and terms of participation of Drion AI AG, unless these are expressly amended or revoked.
10. Liability
10.1 Supplementary Application of the General
Terms and Conditions The liability of Drion AI AG is additionally governed by the liability provisions of the General Terms and Conditions DLA-AGB-001 as amended from time to time. The following provisions supplement these exclusively in respect of the provision and use of AI-supported services under this AI Policy.
10.2
AI-Generated Content AI-supported services may automatically generate content, analyses, recommendations or other results. Drion AI AG does not warrant that AI-generated content is at all times complete, accurate, up to date, error-free or suitable for a particular purpose.
10.3
Use of AI-Generated Content Responsibility for the use, assessment, further processing or publication of AI-generated content lies exclusively with the respective user. Drion AI AG is not liable for disadvantages or damage arising from the use of or reliance on AI-generated content, unless such damage is based on intentional or grossly negligent conduct of Drion AI AG or mandatory statutory provisions provide otherwise.
10.4 Integrated AI Services and Third-Party Services
Where AI-supported services are based on integrated third-party technologies or services, the responsibility of Drion AI AG is, to the extent permitted by law, limited to their contractual provision and integration within the digital ecosystem. Drion AI AG assumes no liability for the availability, functionality or content of such third-party services, insofar as these are not attributable to its area of responsibility. Mandatory statutory liability provisions remain unaffected.
10.5 Availability and Further Development
Drion AI AG does not warrant the continuous and uninterrupted availability of all AI-supported services. In particular, maintenance work, technical disruptions, changes to integrated AI services, security measures or adaptations required by statute or regulation may result in temporary restrictions.
10.6 Users’ Data Responsibility
Users are responsible for backing up their data and AI-generated content, insofar as corresponding export, download or backup functions are available. Drion AI AG is not liable for data loss resulting from users having failed to take reasonable backup measures.
10.7 Statutory Liability
The liability of Drion AI AG for intent and gross negligence as well as under mandatory statutory provisions, in particular in the event of injury to life, limb or health or under mandatory product liability law, remains unaffected.
11. Final Provisions
11.1 Supplementary Application of the General
Terms and Conditions Unless this AI Policy contains provisions to the contrary, the General Terms and Conditions of Drion AI AG DLA-AGB-001 as amended from time to time shall apply in addition.
11.2 Applicable Law
All legal relationships in connection with this AI Policy shall be governed by the substantive law of Switzerland, excluding conflict-of-laws rules as well as the United Nations Convention on Contracts for the International Sale of Goods (CISG). Mandatory statutory consumer protection provisions of the state in which the user has their habitual residence remain unaffected.
11.3 Place of Jurisdiction
To the extent permitted by law, the exclusive place of jurisdiction for all disputes arising out of or in connection with this AI Policy shall be the registered office of Drion AI AG. Mandatory statutory places of jurisdiction as well as mandatory consumer protection provisions remain unaffected.
11.4 Severability
Should individual provisions of this AI Policy be or become wholly or partly invalid, unenforceable or void, the validity of the remaining provisions shall remain unaffected. The invalid or unenforceable provision shall be replaced by the legally permissible provision that most closely approximates the economic purpose of the invalid or unenforceable provision. The same shall apply to any gaps in the provisions.
11.5 Amendments to this AI Policy
Amendments to this AI Policy shall be made exclusively for objective reasons, taking into account the legitimate interests of users as well as the applicable statutory provisions. Users will be informed of material changes in good time and in an appropriate manner.
11.6 Entry into Force
This AI Policy enters into force upon its publication on Neos7.io or on the platforms operated by Drion AI AG. It applies to all AI-supported services and functions as of the time of its entry into force.
11.7 Document Management
This AI Policy is maintained by Drion AI AG under the document identifier DLA-AI-002. The version published on the platforms operated by Drion AI AG and designated as valid shall be decisive in each case. Amendments and versioning are carried out in accordance with the internal documentation and approval processes of Drion AI AG
